Terms and Conditions

These Terms and Conditions (“Terms”) are a binding agreement between you and Simon Fund LLC, trading as JJ Simon Trading (“we”, “us”, “our”), governing your access to and use of jjsimontrades.com and its subdomains (including jj.jjsimontrades.com, irl.jjsimontrades.com and ai.jjsimontrades.com), our live trainings, webinars, video content, mentorship and coaching programs, community access, events, software and any related services (together, the “Services”). By accessing the Services, registering for a training, submitting an application, or purchasing a program, you confirm you have read, understood and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 18 years old and legally able to enter a binding contract. You confirm the information you provide is accurate and that you are not located in, or a resident of, any jurisdiction where use of the Services is prohibited. You are responsible for compliance with the laws that apply to you, including any rules of the prop firms, brokers or platforms you choose to use.

Everything we provide is general education and information about trading and proprietary trading firm (“prop firm”) programs. It is not, and must not be treated as, personalized investment, financial, tax or legal advice, and it is not a recommendation to buy, sell or hold any instrument or to enter into any prop firm evaluation. We are not a registered investment adviser, commodity trading advisor, broker-dealer, futures commission merchant or financial institution, and no fiduciary relationship is created. Any decision to trade, to purchase a prop firm evaluation, or to act on anything you learn from us is yours alone. Consult a licensed professional before making financial decisions.

Trading futures, forex, CFDs, stocks, options and other instruments involves substantial risk of loss and is not suitable for everyone. You can lose some or all of your money, including funds paid for prop firm evaluations. Leverage magnifies both gains and losses. Prop firm evaluations and many funded accounts are simulated environments; payouts are made by the prop firm under its own rules and at its own discretion and can be delayed, reduced or refused. Prop firms are independent third parties that we do not control; some have changed their rules, restricted payouts or ceased operating.

Payout figures, screenshots, certificates and statements shown on the Services are real records belonging to JJ Simon or to students who have given permission to share them. They are shown as examples of what has been achieved, not as a promise or prediction of what you will achieve. They are not typical. Most people who learn to trade do not become consistently profitable, and many lose money. Your results depend on your own effort, discipline, capital, risk tolerance, market conditions, the rules of the prop firm you use and factors outside anyone’s control. Past performance is not indicative of future results. Figures described as “payouts” include payouts from prop firms based on simulated or funded accounts as defined by those firms. Where a student is compensated, sponsored or has any material connection to us beyond being a student, we disclose it. We do not make any representation about the average or typical results of our students. We make no promise of profit, funding or payouts. Any refund is strictly limited to the written refund terms in Section 07.

Prices, inclusions and program durations are stated at the point of purchase. Payments are processed by third-party processors (for example Whop, or any other processor named at checkout); we do not store your full card details. You authorize us to charge the agreed amount, including any installment plan you select. Installment plans are a commitment to the full program price. You are responsible for any taxes. If a payment fails or is reversed, we may suspend access until it is resolved. Chargebacks filed without first contacting us may be treated as a breach of these Terms.

Free trainings, webinars and content carry no fees and no refunds. Paid programs are digital services that begin immediately on purchase. Except as stated in this Section or required by law, all sales are final. Where a program is advertised with a conditional refund (for example: if you do not receive any payout, we refund 100% of the program fee you paid us), that refund applies only under the specific written conditions provided at purchase, which include, at a minimum:

• the refund request is made within the refund period stated on the program's sales page or order form at the time of purchase
• you completed the program curriculum and the required activities
• you followed the risk management rules taught in the program and can document it
• you traded the taught strategy in at least one prop firm evaluation or funded account during the refund period and did not receive any payout
• you provide complete trading records and prop firm account statements when we ask for them
• a written refund request to jjsimontrades@gmail.com before the refund period ends

Refunds under this policy are limited to the program fee actually paid to us and never include prop firm fees, broker losses, tools or any other cost. We may verify claims before approving a refund. EU/UK consumers: if you buy a digital service you have a 14-day right of withdrawal; by requesting immediate access you acknowledge that you lose that right once the service has been fully delivered, and that we may retain a proportionate amount for services delivered before withdrawal. Nothing in this Section limits rights you have under mandatory consumer law.

Access to communities (such as Discord) and events is personal, non-transferable and conditional on respectful conduct. You must not share login credentials, share or resell content, harass others, solicit members, promote other services, give financial advice to other members, or post content that is unlawful. We may remove content and suspend or terminate access for breaches, without refund where the breach is material. Live trainings, webinars, calls and events may be recorded and the recordings shared with registrants as replays; by attending you consent to being recorded.

All content, including videos, strategies, frameworks, documents, software, branding and the “Fair Pricing Theory” materials, is owned by us or our licensors and protected by intellectual property laws. You receive a limited, personal, non-exclusive, non-transferable, revocable license to access the content for your own education during your access period. You may not copy, record, download (unless we provide a download), distribute, publish, teach, resell, reverse engineer or create derivative works from any content. Breach of this Section entitles us to terminate access and pursue legal remedies.

If you submit results, screenshots, reviews, messages or testimonials, you confirm they are genuine and yours to share, and you grant us a worldwide, royalty-free license to use, reproduce and display them (including your first name and image) in our marketing, unless you withdraw consent in writing to jjsimontrades@gmail.com. We will not share your full name or contact details in marketing without separate consent.

The Services rely on independent third parties including prop firms, brokers, trading platforms, payment processors, Kit, Wistia, Typeform, iClosed, Zoom, Discord, Whop, Google and Meta. We do not control them, are not responsible for their availability, rules, decisions or handling of your data, and their own terms apply. Any relationship you enter with a prop firm or broker is between you and that firm.

By providing your details you consent to receive emails from us about trainings, reminders, replays and offers; unsubscribe using the link in any email. Where you tick the SMS consent box you agree to receive recurring automated marketing and informational text messages (like reminders) from JJ Simon Trading at the number provided. Consent is not a condition of purchase. Msg and data rates may apply. Msg frequency varies. Reply STOP to unsubscribe or HELP for help.

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free or that any content will produce any particular result.

To the fullest extent permitted by law, we and our owners, officers, contractors and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any trading losses, lost profits, lost payouts, prop firm fees, data loss or business interruption, arising from or related to the Services or these Terms, even if advised of the possibility. Our total aggregate liability for all claims will not exceed the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations; in those places our liability is limited to the maximum extent permitted.

You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your use of the Services, your trading activity, or your violation of any law or third-party right.

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law rules. Before starting any formal proceeding you agree to contact us at jjsimontrades@gmail.com and attempt to resolve the dispute in good faith for at least 30 days. Subject to mandatory consumer protection law in your country of residence, the courts of the State of Washington, United States have exclusive jurisdiction. To the extent permitted by law, claims must be brought individually and not as a class or representative action, and must be brought within one year of arising.

We may update these Terms by posting a new version with a new “Last updated” date; continued use after changes means acceptance. We may suspend or discontinue any part of the Services. If any provision is unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement between us regarding the Services. Our failure to enforce a provision is not a waiver.
